North East Derbyshire District Council's Ethical Standards Committee met on 4 March 2010 to consider a report into an allegation that Councillor G A Morley when, acting in his capacity as a member of Clay Cross Parish Council, had breached the Members Code of Conduct.
(1) Having given careful consideration to the report, the Committee agreed with the Monitoring Officer's finding that Councillor Morley had not failed to comply with the Members' Code of Conduct.
REASONS
(1) There was insufficient proof that the events described in the allegations actually took place.
(2) It was exceptionally difficult to ascertain whether the conduct alleged took place, there were a number of conflicting accounts and a lack of independent corroboration of the allegations.
