The Three Point Licensing Action Plan


The introduction of new licensing laws under the Licensing Act 2005 gives residents and public bodies more powers than ever before to hold pubs and clubs to account/accountable for rowdy behaviour.
 
A three point plan launched by the LGA (Local Government Association) and LACORS ( Local Authorities Coordinating Office on Regulatory Services) spells out how residents can call for a review of a pub’s licence and make the most of new powers that Councils have to crack down on irresponsible landlords.  People are firstly advised to bring problems to the attention of the pub or club and try to reach an agreement.  But, if this fails, they should:
 
  • Contact the relevant Council’s Licensing Section and/or local Councillor.
  • Keep a record detailing the unacceptable behaviour and contact the Police for serious incidents.
  • Be willing to present their views to the Council’s Licensing Sub-Committee
 
Councillor Bryony Rudkin, Chair of the LGA’s Safer Communities Board said:
"Communities all over the country are looking forward to the challenge and opportunity the new legislation offers and their local Council’s are ready to help them."
 
"If everyone acts as a responsible neighbour – that’s businesses, individual licensees as well as residents – then communities as a whole will benefit.  Let your council know if you have concerns about how the new regulations are working in your area and they will take action."
Councillor Geoffrey Theobald, Chairman of LACORS said:
"We would like to encourage residents to report any disruptive behaviour and public nuisance associated with licensed premises.  Local Authorities now have enhanced powers to deal with any premises that contravene the aims of the Licensing Act and residents have an important part in protecting the local communities."

Rights of Freeholder etc to be Notified of Licensing Matters

 
A person with a property interest in any premises in the area of the licensing authority may give notice of his/her interest to that authority on the prescribed form accompanied by the prescribed fee of £21.

The Licensing Authority register is available for inspection from the Licensing Team from Monday to Friday 9 am 'til 5 pm.
