Smoke Free Premises in North East Derbyshire
It is an offence to:
- Smoke in any smoke free premises.
- Permit others to smoke in any smoke free premises.
- Fail to display warning notices in smoke free premises.
Smoke free premises
The new law will apply to all "enclosed" and "substantially enclosed" public places and workplaces. This includes both permanent and temporary premises, such as tents and marquees.
- A premises is considered "enclosed" if it has a roof or ceiling and, with the exception of doors, windows or passageways, are wholly enclosed either on a permanent or temporary basis.
- A "substantially enclosed" premises has a ceiling/roof, but have an opening in the walls which is less than half the total area of the walls. This does not include doors, windows or any fittings that can be opened or shut.

Smoke free vehicles
The vehicles covered by the new smoke free law are:
- Public transport vehicles (buses, trams, trains, taxis etc)
- Any work vehicle used by more than one person, regardless of whether there is more than one person in the vehicle. This applies to paid or voluntary workers.
What your business needs to do to comply with the new law
- Don't smoke in smoke free premises
- Don't allow anyone else to smoke in smoke free premises
- Display standard "no smoking" signs at all entrances and exits.
- Display "no smoking" signs in company vehicles.
- It is also recommended that businesses have a smoking policy in place.
What will happen if a business ignores the new law?
- Any owner of a premises who allows smoking in a smoke free premises will be liable to a £2,500 fine.
- If members of the public, or employees, smoke in a smoke free premise they will be liable to a £200 fines or a £50 fixed penalty notice.
- Failure to display "no smoking" signs in smoke free premises and vehicles will make the owner of the business liable to a £1,000 fine or a £200 fixed penalty notice.
Cost of fines
- Failure to display a no smoking sign in a smoke free premises face up to £1,000 fine or a fixed penalty of £200
- Smoking in a non smoking area face a £200 fine or a fixed penalty of £50
- Failure to prevent smoking in a smoke free premises face up to £2,500 fine
The approach adopted by an employer in developing a policy will determine its success. It is essential that a smoke-free workplace be promoted in terms of the positive benefits.
