Planning - Advertisements and Shop Signs

 The display of advertisements is governed by the Town and Country Planning (Control of Advertisements) Regulations 1992, and Regulation 5 provides that no advertisement may be displayed without consent granted by the local planning authority or by the Secretary of State (express consent) or granted by Regulation 6 (deemed consent). An advertisement displayed with express consent has been subject of a grant of permission following an application to the local planning authority.
 
An application displayed with deemed consent is one of a wide range of advertisement granted permission by Regulation 6 of the advertisement regulations without the need to apply to the local planning authority.
 
The unauthorised display of advertisements is a criminal offence subject on conviction to a maximum fine of £2,500 per advertisement.
 
It is therefore important that prior to erecting new advertisements or altering existing ones that the advertiser has ensured that the advertisements to be displayed benefit from deemed consent or have the approval of the local planning authority.

Alternatively advice is available from the Council's planning officers whose details are given on the Development Control Team page. When consulting officers, information relating to the size of the sign, its proposed location, content and method of illumination (if it is to be illuminated) will be required in order to determine if an application to display the advertisement is necessary.

From April this year all planning applications submitted to this and all other Local Planning Authorities will need to be completed using the new national planning application form known as 1APP.
 
Local Planning Authorities may introduce 1APP ahead of the April deadline and many have already done so. The Council has agreed that the submission of applications electronically via the planning portal to the Council will take place on the new forms from the 3rd March, subject to final confirmation.
 
Please note that to coincide with that, it is also intended that applications may be submitted to this Council on the new 1APP forms from that date too.
