Planning - Information on Making Appeals
An appeal may be submitted by an applicant, or an agent working on their behalf, where permission has been refused, or permitted with conditions which the applicant considers to be unacceptable. There is also a right of appeal in relation to non-determination of an application within the statutory 8-week time limit.
The appeal is made to the Office of the Deputy Prime Minister in accordance with Sections 78/79 of the Town and Country Planning Act 1990. The appeal is dealt with by the Planning Inspectorate, based in Bristol. Further advice on making an appeal is given on the back of the decision notice you will have received from this Council.

The submission of an appeal must be within 6 months of the date of the decision notice, or 8 weeks in the case of advertisement consent. Appeals in relation to non-determination may be made at any time after 8 weeks from the receipt of a valid application.
Before you lodge an appeal, it can be helpful to speak to the relevant Planning Officer to see if any of the reasons for refusal, conditions or delay in determination, could be overcome by submitting an amended scheme which overcomes the previous problems.
It is also possible to appeal against an Enforcement Notice under Section 174(2) of the Town and Country Planning Act 1990. In this case, the appeal must be submitted to the Planning Inspectorate before the date on which the notice takes effect. Appeal forms are sent out with the Enforcement Notice.
Appeals concerning applications regarding trees which are covered by Tree Preservation Orders are now dealt with by the The Planning Inspectorate, and must be made within 4 weeks of the decision letter.
It is possible to submit an Appeal On-Line and for third parties to track the process of a current Appeal via The Planning Casework Service on the Planning Portal.
