A new system of local development planning
In September 2004, the Government made major changes to the planning system under the Planning and Compulsory Purchase Act 2004. In the future, the Council will not be producing a Local Plan as it has done until now, but will set out its plans and proposals for development in the District in a Local Development Framework. Planning applications will subsequently be considered against the policies set out in this Framework.
Under the Planning Act 2004, the Council is responsible for setting out its planning policies in a Local Development Framework (LDF). In broad terms it is a local framework setting out the location and design of new development (homes, businesses, etc) whilst protecting the natural and built environment. For North East Derbyshire this will be called the North East Derbyshire Development Framework.
Unlike the Local Plan it replaces, the LDF is not a single document but a ‘folder’ into which a series of documents called Local Development Documents are placed. Some of these documents will prescribe planning policies and proposals and will have legal status in the determination of planning applications and are termed Development Plan Documents. Other documents will inform development, such as design guides and development briefs; these are termed Supplementary Planning Documents.
Under the provisions of the 2004 Act, the North East Derbyshire Local Plan (Adopted November 2005) will be saved for a period of three years. It will therefore continue to form part of the Development Plan and LDF for the District until November 2008 and decisions on Planning Applications will be made in accordance with it The Council has produced a timetable for the production of the new documents to replace the Local Plan as part of the LDF
The Council’s most up to date Local Development Scheme sets out which LDF documents the Council will be producing and when. It is the starting point for the community and stakeholders to find out about the Council’s planning policies. The North East Derbyshire Development Framework will include the following documents:
Statement of Community Involvement:
The Statement sets out how the Council will involve the local community and stakeholders in preparing the LDF documents and in considering planning applications
Development Plan Documents, including:
Core Strategy:
The Core Strategy sets out the key elements of the planning framework for the area. It comprises a spatial vision and strategic objectives, with strategic core policies to identify broad locations for future developments and other areas of restraint. It will also include a monitoring and implementation framework. The other Development Plan Documents must be in conformity with this Core Strategy.
Housing Allocation Development Plan Documents:
The Site Allocations documents will allocate specific sites for housing development.
Employment Allocation Development Plan Documents:
The Site Allocations documents will allocate specific sites for housing development.
Proposals Map:
The Proposals Map shows the policies and proposals of the Development Plan Documents on an Ordnance Survey base map. The map will be updated as and when a Development Plan Document is updated.
Sustainability Appraisals are a requirement of the Planning and Compulsory Purchase Act 2004 (Section 39(2)) and must be undertaken for new and revised Development Plan Documents or Supplementary Planning Documents (SPDs). The purpose of a Sustainability Appraisal is to promote sustainable development through the integration of social, environmental and economic considerations into the preparation and adoption of plans.
Supplementary Planning Documents:
These are non-statutory documents used to supplement policies and strategies set out in the Development Plan Documents. These may be design guides, topic based documents or area development briefs. Currently the Council intends to prepare the following Supplementary Planning Documents:
Access for All: guidance on providing for inclusive physical access to buildings and open spaces for people of all abilities
Recreation and Open Space: guidance on providing sufficient and good quality recreation facilities
Developer Contributions: setting out the requirements for developer contributions towards community facilities, road improvements and other improvements.
Residential Design Guidance: for improving the standard of housing design.
Affordable Housing: guidance on providing affordable housing.
This is an annual report which monitors the policies used within the Framework documents and whether the Council is meeting the milestones for preparing these documents as set out in the Local Development Scheme.
