Developer Contributions Supplementary Planning Document
This document is intended to provide clarity on the use of Planning Obligations and is aimed at developers, applicants, planning consultants, architects, officers of the Council and elected members (who may be involved with making decisions on planning applications.
This document was adopted on 27th September 2007 and forms part of the North East Derbyshire Local Development Framework. A copy of the document can be downloaded below. Paper copies are available to buy for £5.00.
Section 106 Agreements are private legal agreements between a local planning authority and an applicant (for planning permission) /developer and any other person who may have an interest in the application site.
Planning Obligations are a very important part of the planning process and can lead to significant improvement to a community’s well being, as well as ensuring that no harm arises out of granting planning permission for a significant development. Planning Obligations generally only apply to larger developments and do not generally apply to the majority of applications processed by the Council.
Amendment to Developer Contributions SPD
The Council has amended paragraph 4.74 of the Developer Contributions SPD to ensure consistency with the Adopted North East Derbyshire Local Plan as set out in the notice below.
