Racial Harassment

Does the Council have a policy on Racial Harassment?

 
Racial harassment is defined as: “A deliberate act which interferes with the peace and comfort of an individual's quality of life and then the act has been committed against the individual because of his or her colour, race or ethnic origination”.
 
We recognise that Racial Harassment is a serious matter which affects and concerns members of ethnic communities.
Rykneld Homes has adopted a Racial Harassment Policy to effectively deal with reported cases of racial harassment and to make clear to all its tenants the seriousness with which Rykneld views such racist behaviour and to make known the action it will take against the perpetrators of such acts.
 

Racial harassment is an act which is racially motivated. It includes but is not limited to:

 
  • violence, threats of violence or intimidating behaviour towards any person
  • abusive or insulting words or behaviour
  • damage or threats of damage to property
  • writing threatening, abusive or  insulting graffiti
  • any act or omission calculated to interfere with the peace or comfort of any other person or to inconvenience such a person.
 
North East Derbyshire District Council and Rykneld Homes takes their responsibilities under Section 71 of the Race Relations Act seriously and is committed to ensuring that all Local Authority tenants enjoy a nuisance-free tenancy, free from fear of intimidation, abuse or assault, and where it can be proved that one tenant is harassing another, is prepared to take what action is necessary to stop this.  Tenants must be  fully aware that they may be evicted if their children are persistently harassing neighbours and that the local authority may treat them as intentionally homeless in which case they will not be re-housed. 
 
If we receive a complaint that could involve racial harassment we will start to investigate within 24 hours of receiving the complaint. Any racist graffiti will be removed immediately.
