Managing a House in Multiple Occupation

Anyone managing a House in Multiple Occupation (HMO) is regulated by the Management of Houses in Multiple Occupation (England) Regulations 2006.
 
The manager may be the owner, person in control, person receiving rent, agent or any other specially designated person.

The manager must ensure that:

 
  • his/her contact details are given to the occupants and displayed within the property in the case of an emergency
  • the escape route is kept free from obstruction, is maintained, and where necessary notices are provided
  • fire-fighting equipment and fire alarm systems are maintained in good working order
  • reasonable measure is taken to protect the tenants from injury, taking account of the design; structural conditions and number of occupants.  This covers safeguarding low level windows, unsafe balconies, etc.
  • water supply and drainage is maintained in good order
  • gas, electrical supplies and installations are uninterrupted and maintained in good working order
  • a gas safety certificate is available and supplied on request to the Council
  • fixed electrical installation is inspected and tested at least every 5 years by a qualified and competent person; a certificate is to be obtained, which may be requested by the Council
  • common parts, fixtures, fittings and appliances are maintained in good and clean decorative repair, maintained in a safe and working condition and kept reasonably clear from obstruction.; this covers banisters and handrails, stair coverings, windows, lighting, gardens and yards, walls and fences, etc.
  • living accommodation, windows and installations and appliances provided are maintained
  • each room is in a clean condition at the beginning of the tenant’s occupation of it
  • provision is made for adequate disposal of refuse and litter.

Tenants responsibilities and duties:


To allow managers to fulfil their legal obligations tenants also have responsibilities under the regulations.
 
Tenants must:
 
  • allow access to the manager at reasonable times and provide information necessary to carry out his/her management duties
  • comply with the manager’s arrangements, including those for means of escape from fire, refuse storage and disposal,
  • not damage the property

How we enforce the regulations

 
Intervention is normally dependent on the level of risk and where formal enforcement is taken (which might be by service of a notice, or prosecution) we follow our Private Sector Housing Enforcement Policy. Failure to comply may result in prosecution, which incurs a maximum fine of £5000.
