Pavement Maintenance


Who looks after pavements within the district?

 
Derbyshire County Council, as the Highway Authority for Derbyshire, is responsible for the upkeep of the large majority of pavements within our District.  However, there are certain roads where North East Derbyshire District Council is the responsible authority. 
 
To check if a pavement you would like to report a problem on comes under the jurisdiction of North East Derbyshire District Council, please contact one of our team (details at the bottom of the page).

Private Streets

 
However, private streets are not the responsibility of either Derbyshire County Council or North East Derbyshire District Council, unless they have been adopted.  The responsibility for the maintenance of private streets lies with the street owners. 
 
If the private street has been adopted by the Council, this means that the Council has agreed to manage the upkeep and maintenance of the street on the owner’s behalf.  The Council will usually only adopt a private street that has been brought up to current standards.

Hazards on Pavements

 
Trip hazards are a key concern on pavements.  We also deal with seasonal problems such as weeds, standing water and ice.  We address these problems in order of priority:
 
1.   Slab movement, uneven ironwork, and edge depressions with a trip of 20mm or more
2.   Overhanging vegetation
3.   Major cracking
 
If you witness any damage being done to pavements in North East Derbyshire, please report this to us. If possible, please provide us with the vehicle details, and what you saw, so that the council can recover the full cost of repairs to the pavement.
 
When work is being carried out on the roads (including the pavement/footway), the organisation carrying out those works (including utility companies) is responsible for ensuring that
 
  • there is a safe diversionary route for pedestrians and other traffic while the work is being  done
 
  • and they restore the pavement to a satisfactory standard when the work has finished
 
Any building materials that block the pavement cause an obstruction to pedestrians, and are potentially dangerous. If you encounter any of the following problems, please contact us.
 
  • Skips / scaffolding / advertising boards blocking the pavement.
  • No barriers around streetworks / roadworks
  • Banners or bunting causing an obstruction, or 
  •  Any other building materials blocking the pavement, or building work that is endangering pedestrians.
