The Council's Policy on Fly Tipping
North East Derbyshire District Council is responsible for the removal of fly-tipped waste on public land or the adopted highway.
What is Fly Tipping?
Fly-tipping is the unauthorised dumping of waste on public or private land by persons who do not have the occupier or owner’s permission to do so, and land for which a relevant waste management licence does not exist.
Fly-tipping is a major cause of public dissatisfaction and, if remains un-cleared for extended periods of time, seriously detracts from the amenity value of the area and could lead to injury to people and wildlife, in particular where the waste is of an hazardous nature.
The Council’s Responsibilities and Commitments
Fly tipping is illegal and irresponsible. It is an offence under Section 33(a) of the Environmental Protection Act 1990 to deposit waste on any land other than that which is controlled by a waste management licence.
There is a fixed penalty of £50 for anyone found guilty of littering in North East Derbyshire. Non-payment of this fixed penalty may end in legal action. Conviction of this offence can carry a fine of up to £20,000 and/or six months imprisonment. Higher fines and longer sentences may be imposed by the Crown Court.
The Council is committed to the prosecution of offenders and urges the public to report all matters of fly-tipping and help the Council bring to justice persons who dispose of their waste illegally.
If you witness someone illegally disposing of their waste, please report this to the Council giving as much information as possible about the offender. Any information provided will be treated in the strictest confidence and greatly assist the Council to take the enforcement action against fly-tippers.
How is Fly-Tipping on Private Land Dealt With?
If the land is privately owned, North East Derbyshire District Council will try to identify and contact the occupier or land owner to take steps to require them to remove the waste. Making such arrangements with private land occupiers and owners may in general take longer to arrange than removal of waste from Council land. Please report unauthorised dumping on private land.
How is Fly-Tipping on Council Owned Land Dealt With?
North East Derbyshire District Council will remove fly-tipped waste if it is on the public highway or council-owned land. This will generally be undertaken within 5 working days from notification.
Safety advice on fly tipping
If you discover fly-tipped waste please keep in mind that it may contain syringes, broken glass, asbestos, toxic chemicals or other hazardous substances. Many infectious diseases such as Hepatitis and AIDS can be transmitted through the use of shared needles therefore they are regarded as a serious health risk. We urge you to contact us immediately.
How do I report fly-tipping?
When reporting fly-tipping please give us the location as accurately as possible e.g. street name, nearby land mark. This will assist us in locating the offending waste and to make arrangements for its removal.
